Terms of Service

These Terms of Service govern services provided by Daily Enigma. By requesting, approving, paying for, or using our services, you agree to these terms and any written project agreement that applies.

Services

Daily Enigma provides software development, software auditing, UI/UX design, mobile and web app design, branding, logo design, and related consulting services. The exact scope, timeline, price, deliverables, revision limits, and responsibilities for each project are defined in the applicable proposal, statement of work, invoice, or written agreement.

Client responsibilities

Clients agree to provide timely access, content, credentials, feedback, approvals, business requirements, and accurate information needed to complete the work. Delays in client inputs may delay timelines or require scope adjustments.

Payments

Fees are due according to the invoice or written agreement. Work may be paused for overdue invoices. Unless stated otherwise in writing, taxes, third-party software, paid fonts, stock assets, hosting, domains, app store fees, printing, and advertising spend are separate from service fees.

Ownership and licenses

After full payment, the client receives ownership or an agreed license to final deliverables created specifically for the client, except for pre-existing tools, templates, libraries, know-how, open-source components, third-party assets, and reusable methods. Drafts, unused concepts, and internal working files remain property of Daily Enigma unless otherwise agreed in writing.

Portfolio use

Unless restricted by a written confidentiality agreement, Daily Enigma may reference completed public-facing work in portfolios, proposals, case studies, and marketing materials. Confidential or private project details will not be disclosed without permission.

No guarantee of specific outcomes

We aim to deliver excellent work, but we do not guarantee any particular revenue, ranking, conversion rate, app approval, funding result, or business outcome. Client results depend on many factors outside our control.

Acceptable use

Clients may not use our services or deliverables for unlawful activity, infringement, fraud, deceptive practices, malware, harassment, or other harmful behavior. We may refuse or stop work that creates legal, security, ethical, payment, or platform risk.

Limitation of liability

To the maximum extent permitted by law, Daily Enigma is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages. Our total liability for a project is limited to the amount paid to Daily Enigma for the specific services giving rise to the claim.
